Environmental Quality (Schedule Wastes) (Amendment) Regulations 2007

Regulation 2 - Schedule waste means any waste falling within the categories of waste listed in the first schedule.
Regulation 3 - Notification of the generation of scheduled wastes. Waste generator shall notify Director General within 30 days.
Regulation 4 - Disposal of scheduled wastes at prescribed premises only.
Regulation 5 - Treatment of scheduled wastes on-site or at prescribed premises only.
Regulation 6 - Recovery of scheduled waste on-site or at prescribed premises only and the residuals shall be disposed at prescribed premises.

Special management of scheduled wastes
Waste generator may apply to exclude a specific schedule waste from being treated / disposed of / recovered at prescribed premises.
An application shall be submitted in accordance with the prescribed Guidelines together with RM300.00 processing fee.
Director General may grant a written approval either with or without conditions.

Responsibility of waste generator.
Waste generator shall ensure that schedule wastes are: properly packed, labeled & stored. Treated / recovered on-site, or safely delivered and received at prescribed premises.

Storage of scheduled wastes in compatible and durable container
Incompatible schedule waste in separate container and in separate containment area.
Schedule waste container shall always be closed.
Proper schedule waste storage area to prevent spillage into the environment.
Waste generator may store schedule waste up to 180 days or 20 tonnes.

The date when the scheduled wastes are first generated, name, address and telephone number of waste generator shall be clearly mark on the container.
Scheduled wastes container shall be clearly labeled and marked with code.

Inventory of scheduled waste
Waste generator shall keep accurate & up-to-date inventory.
Waste generator shall keep the record up to three years from the date the schedule waste was generated.
Regulation 12 -

Schedule waste tracking and monitoring by consignment note
Waste Generator, Waste Transporter, Waste Receiver shall retain the consignment note for three years.

Waste information, method of handling and emergency response procedure shall be provided to the wastes transporter.
Waste generator shall provide information as in the Seventh Schedule to the wastes transporter and shall explain the use of the schedule.
Waste transporter shall ensure all his employees attend training programme and understand the purpose and use of the seventh schedule.

Spill or accidental discharge
Waste transporter shall immediately inform the Director General.
Waste transporter shall cleanse the affected site with the expertise support from the waste generator.
Waste transporter shall undertake studies to determine the impact of the spillage on the environment.
Regulation 15 - Waste generator shall ensure that all his employees involve in schedule waste attend training programme.
Regulation 16 - Every offence under this regulation may be compounded.
